The leading motives of our law and our procedure have always been constant, founded as they are upon a Spirit of equity and of self-government, and even now, with their suggested crudity, are the admiration of foreign jurists. But we have always sacrificed science and symmetry on the altar of utility. Our judges from time im memorial would rather give an ephemeral judgment doing practical justice between a man and his neigh bour than deliver one of lasting reputation dealing with great interests and world-wide principles; our courts, in which all classes of our laymen take.
